These Terms of Use (the "Terms") are a binding agreement between you and Dinero Summit, LLC ("Dinero Summit," "we," or "us"). By creating an account, clicking a button indicating acceptance, or using dinerosummit.ai and our related applications and services (together, the "Service"), you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old and reside in the United States to use the Service.
PLEASE NOTE: SECTION 12 CONTAINS A BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER. THEY AFFECT HOW DISPUTES BETWEEN YOU AND DINERO SUMMIT ARE RESOLVED. PLEASE READ THEM CAREFULLY.
Dinero Summit provides automated, software-based tools that help you organize and understand your finances, including analyses and recommendations generated by artificial intelligence, and a feature through which you may ask to be matched with third-party providers of financial products and services.
DINERO SUMMIT IS NOT A REGISTERED INVESTMENT ADVISER, BROKER-DEALER, FINANCIAL PLANNER, LENDER, CREDIT REPAIR ORGANIZATION, OR LICENSED INSURANCE PRODUCER. THE SERVICE, INCLUDING ALL AI-GENERATED CONTENT, IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY AND IS NOT FINANCIAL, INVESTMENT, LEGAL, TAX, CREDIT REPAIR, OR INSURANCE ADVICE.
Outputs generated by the Service are produced by automated systems, are based on the information you provide and on general assumptions, and may be inaccurate or incomplete. Verify important information and consult a qualified professional before making significant financial decisions.
You agree to provide accurate and current information when you register and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized use of your account.
New users receive a 30-day free trial. Before you provide a payment method, we will disclose the price of the subscription tier you select, the date your trial ends, and the date billing begins. Unless you cancel before the end of the trial, your subscription begins automatically and your payment method will be charged the disclosed monthly price for your tier on a recurring basis until you cancel.
You may cancel at any time in Settings or at dinerosummit.ai/cancel. Cancellation takes effect at the end of the then-current billing period, and you will not be charged again. Except where required by law, amounts already paid are not refunded. We may change subscription prices on at least 30 days’ advance notice; changes apply from your next billing period. If you subscribe through the Apple App Store or Google Play, billing is processed by the app store, and you can also cancel through your app store subscription settings; the app store’s terms apply to those transactions.
You may choose to link financial accounts to the Service through our third-party data provider, Plaid. By linking an account, you authorize Dinero Summit to access and use the account data made available by Plaid (such as balances and transactions) to provide the Service. Your bank login credentials are provided directly to Plaid and are not stored on Dinero Summit servers. Account data originates with your financial institutions, and we are not responsible for its accuracy or availability. Plaid’s use of your information is governed by its own privacy policy.
Dinero Summit is not a lender or insurer and does not make credit or underwriting decisions. If you ask to be matched, Dinero Summit will identify the matched partner to you, and your information is sent to a partner only if you then choose to connect with that partner. Each partner decides independently whether to offer you its products and on what terms. Matches are based on the goals and financial information you provide. Dinero Summit receives compensation from a partner only if you obtain a product from, or enroll in a program with, that partner; compensation does not determine which partners you are matched with or the order in which they appear. A match is not an offer, approval, or guarantee of any product, rate, or term. Any product you obtain from a partner is governed by that partner’s own agreements and policies, and Dinero Summit is not a party to them.
You agree to use the Service only for your own personal, non-commercial purposes and in compliance with law. You may not misrepresent your identity; access another person’s account or link accounts you are not authorized to use; copy, scrape, or reverse engineer the Service; interfere with its operation or security; or use the Service to develop a competing product.
The Service, including its software, content, and trademarks, is owned by Dinero Summit or its licensors. We grant you a limited, personal, non-exclusive, non-transferable license to use the Service in accordance with these Terms. If you provide feedback or suggestions, we may use them without restriction or compensation to you.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, DINERO SUMMIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DINERO SUMMIT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY OUTPUT WILL BE ACCURATE OR COMPLETE, OR THAT USE OF THE SERVICE WILL PRODUCE ANY PARTICULAR FINANCIAL RESULT OR SAVINGS.
TO THE FULLEST EXTENT PERMITTED BY LAW, DINERO SUMMIT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. DINERO SUMMIT’ TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID DINERO SUMMIT IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED DOLLARS ($100). SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless Dinero Summit and its officers, directors, employees, and agents from claims, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Service.
(a) Informal resolution first. Before filing a claim, you and Dinero Summit agree to try to resolve the dispute informally. Either party may send a written notice of dispute to the other (to Dinero Summit at [email protected]; to you at the email address on your account) describing the dispute and the relief sought. If the dispute is not resolved within 30 days after the notice is received, either party may commence arbitration.
(b) Binding arbitration. Except as provided in subsection (d), any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration before a single arbitrator, administered by JAMS under its Comprehensive Arbitration Rules and Procedures (or, where applicable, its Streamlined Arbitration Rules and Procedures) and, for disputes with consumers, the JAMS Consumer Arbitration Minimum Standards. The Federal Arbitration Act governs the interpretation and enforcement of this Section. The arbitration will be conducted in the county where you reside or, at your election, by videoconference. Arbitration fees will be allocated in accordance with the applicable JAMS rules and consumer standards. Judgment on the award may be entered in any court of competent jurisdiction.
(c) Class action waiver. YOU AND DINERO SUMMIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court, and the remainder will proceed in arbitration.
(d) Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property or unauthorized access to the Service.
(e) Opt-out. You may opt out of this arbitration agreement and class action waiver by sending written notice to Dinero Summit at [email protected] within 30 days after you first accept these Terms, stating your name, account email, and intent to opt out. Opting out does not affect any other provision of these Terms.
These Terms and any dispute arising out of them are governed by the laws of the State of Indiana, without regard to its conflict of laws principles, except that the Federal Arbitration Act governs Section 12. For any action that is not subject to arbitration, you and Dinero Summit consent to the exclusive jurisdiction and venue of the state and federal courts located in Allen County, Indiana.
We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will notify you by email or through the Service before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service, and we will provide notice where practicable. Sections 2 and 8 through 13 survive termination.
These Terms and the Privacy Policy are the entire agreement between you and Dinero Summit regarding the Service. If any provision is found unenforceable, the remainder will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Questions may be directed to [email protected] or by mail to Dinero Summit, LLC.
